A car accident in Louisiana has left two children in critical condition. Authorities have since arrested a man for drunk driving. The car accident occurred when a 35-year-old woman was traveling north on La. 445 with her two young children. A 58-year-old man driving a pickup truck turned directly into the path of the woman's vehicle.
The man was attempting to turn left onto the I-12 eastbound ramp. The mother sustained injuries, but her two children were much worse off and had to be airlifted to a hospital in New Orleans. The mother is not suspected of any alcohol use, but toxicology tests have been ordered. However, the pickup driver apparently had a blood alcohol level higher than .08 percent.
This level is considered to be presumptive evidence the man was driving while intoxicated. This is not the man's first run-in with authorities when it comes to drunk driving. He was arrested before on DWI charges. He has since been arrested and charged with first-degree vehicular negligent injuring, second-offense DWI and failure to yield when turning left at an intersection.
Unfortunately, the Louisiana mother may also face legal difficulties for this car accident, and additional charges could be leveled against both drivers. From the investigation, it appears neither of her children was properly restrained in the crash. However, the man's drunk driving and suggested negligence in the crash could open up legal avenues for restitution on behalf of the injured children. Once the accident report is finished, the findings may provide more evidence from this crash that will enable the parties to assess their rights and responsibilities under our state laws.
